In any calendar year, benchmarking shall not be required as follows:
- If more than 50% of the indoor floor space is unoccupied for more than 180 days in total.
- If benchmarking or disclosure would cause exceptional hardship or would not be in the public interest.
- In buildings primarily used for manufacturing or other industrial purposes for which benchmarking results would not meaningfully reflect building energy use characteristics due to the intensive use of process energy. “Process energy” refers to energy used in the actual manufacturing, production, or processing of a good, commodity, or other material.
- If building ownership changed during 2021 and is not available to a full calendar year of utility bills.
Should your building meet any of the above criteria, please file for an exemption using the form at the bottom of this page and click Submit by June 30, 2022.
Please note that if your building has received a vacancy exemption in 2020, and remained vacant in 2021, you will need to re-file for exemption by June 30th, 2022.
If your building is no longer vacant or received an exemption for change of ownership in 2020, you will need to benchmark 2021 energy and water data by June 30th, 2022.
